Chapter 10: The Custody Hearing
Benjamin remained in neonatal care for seventeen days.
During that time, Nathaniel filed an emergency request for unrestricted access.
The custody hearing took place in a closed family courtroom.
Sophia attended remotely from a hospital conference room, unwilling to leave her son longer than necessary.
Nathaniel sat beside Charles Mercer.
The judge reviewed the filings.
“Mr. Cross seeks immediate visitation and shared decision-making authority.”
Mercer stood.
“My client has not been convicted of any crime. He has a constitutional and emotional interest in knowing his child.”
Olivia rose.
“No one disputes biological parentage. However, Mr. Cross forged or directed others to forge my client’s signature, diverted assets intended for their child, and attempted to position Mrs. Cross as the responsible party.”
“Allegedly,” Mercer said.
Olivia handed documents to the clerk.
“The court may also consider Mr. Cross’s absence from prenatal appointments, his repeated failure to respond during medical emergencies, and messages showing he planned to leave the country if the investigation expanded.”
Nathaniel turned sharply toward his attorney.
Sophia had not known about the travel plan.
Olivia continued.
“Two days before Benjamin’s birth, Mr. Cross asked an aviation company about a private flight to the Cayman Islands.”
Nathaniel stood.
“That was business.”
The judge looked at him.
“Sit down.”
He obeyed.
Sophia watched from the screen.
The man who once controlled every room now struggled to remain silent in one.
The judge granted temporary sole legal and physical custody to Sophia.
Nathaniel would receive supervised visitation after Benjamin’s doctors determined it was medically appropriate.
He was also prohibited from removing the child from New York State.
When the hearing ended, Nathaniel approached the video monitor.
“Sophia.”
She remained seated.
“I never would have taken him away from you.”
“You prepared to leave the country.”
“I was trying to protect company assets.”
“You mean yourself.”
Nathaniel’s voice lowered.
“I want to meet my son.”
“You will, under the court’s conditions.”
“He needs his father.”
Sophia looked toward the neonatal unit beyond the glass.
“He needs stability.”
“I love him.”
“You loved the idea of him.”
Nathaniel flinched.
Sophia continued quietly.
“Love is not the pair of shoes you bought. It is not the crib you promised to build. Love is being present when no one is watching.”
The connection ended.
Nathaniel stared at the dark screen.
In the hospital, Sophia returned to Benjamin.
A nurse smiled as she approached.
“He gained two ounces today.”
