McConnell Praises SCOTUS Ruling Against Trump’s Authority on Tariffs

Sen. Mitch McConnell said Friday that a recent Supreme Court of the United States decision rejecting President Donald Trump’s use of emergency powers to impose sweeping tariffs reaffirmed Congress’ long-standing constitutional authority over taxation and trade policy.

In a statement released Friday afternoon, McConnell said the court’s ruling “reaffirmed authority that has rested with Congress for centuries.” The decision came after the justices concluded that several tariffs imposed by the Trump administration were not authorized under the International Emergency Economic Powers Act (IEEPA).

The court ruled that IEEPA does not grant the president the authority to impose tariffs. John Roberts wrote the majority opinion in the case Learning Resources Inc. v. Trump, which resulted in a 6–3 decision.

McConnell emphasized that Congress’ constitutional role in shaping trade policy cannot be bypassed. “Congress’ role in trade policy, as I have warned repeatedly, is not an inconvenience to avoid,” McConnell said. “If the executive branch wants to enact trade policies that affect American producers and consumers, the path forward is clear: convince their representatives under Article I.”

The Kentucky senator was also among four Republicans who voted in October for a Senate resolution calling on the Trump administration to repeal tariffs imposed on foreign nations. The measure passed the Senate 51–47 on Oct. 30. McConnell joined fellow Republican senators Susan Collins, Rand Paul, and Lisa Murkowski in supporting the resolution.

The vote came as opposition to the tariffs from both businesses and consumers continued to grow.
