Supreme Court Clears Path for Trump to Remove Democrat Appointees From Federal Board

The Supreme Court on Wednesday allowed President Donald Trump to proceed with removing three members of the Consumer Product Safety Commission (CPSC), marking the second instance in which the Court has permitted his dismissal of officials from independent federal agencies.

In an emergency order, the justices set aside a lower court decision that had previously blocked the removals and directed that Commissioners Mary Boyle, Alexander Hoehn-Saric, and Richard Trumka Jr. be reinstated while the legal battle moved forward.

The Court’s majority pointed to its earlier emergency ruling issued in May, which upheld Trump’s authority to remove officials from two other independent agencies. According to the justices, the structure and legal protections of the Consumer Product Safety Commission were not meaningfully different from those agencies.

Although the Court emphasized that its temporary orders do not determine the final outcome of the case, the unsigned ruling suggested that such interim decisions should guide lower courts when handling similar disputes.

Three justices appointed by Democratic presidents openly dissented from the ruling. Justice Elena Kagan, joined by Justices Sonia Sotomayor and Ketanji Brown Jackson, warned that the decision undermines Congress’s intent to maintain independent and bipartisan regulatory agencies.
