Chapter 2 - THE FRAUD CLAUSE

The paramedics helped me onto a stretcher while one of the officers remained near Richard.

I held my phone tightly.

“What exactly is the fraud clause?”

Margaret answered without hesitation.

“Daniel knew your father had been pressuring him about the company.”

My heart sank.

“Daniel never told me that.”

“He was trying to protect you from it.”

The stretcher started moving toward the ambulance.

Margaret continued.

“Six months ago, Daniel amended the Hale-Mercer family trust.”

“Why?”

“Because Richard asked Daniel to guarantee a private loan.”

I closed my eyes.

That sounded exactly like my father.

Richard always called reckless decisions opportunities.

Daniel had called them traps.

Margaret lowered her voice.

“The trust amendment says that any beneficiary, director, or related party who attempts to obtain estate property through coercion, forgery, fraud, or incapacity manipulation immediately loses access to trust-controlled voting rights.”

I opened my eyes.

“Voting rights?”

“Hale-Mercer Logistics.”

The name hit differently now.

The company had started as my grandfather’s trucking business.

Richard expanded it.

Daniel transformed it.

By the time Daniel died, the company operated warehouses and freight routes across seven states.

Everyone had always treated Richard as the unquestioned head of the family business.

Apparently, Daniel had not.

Margaret continued.

“Daniel personally owned thirty-eight percent.”

I swallowed.

“I knew that.”

“Your marital trust controls another seventeen percent.”

My breath stopped.

“That gives the trust fifty-five percent.”

“Yes.”

“And I control the trust?”

“Under normal circumstances, you and Daniel were co-trustees.”

Her voice softened.

“After his death, you became the sole controlling trustee.”

The ambulance doors remained open while the paramedics prepared equipment.

Across the yard, Richard was arguing with an officer.

Kelsey stood several feet away from him now.

Margaret continued.

“The deed filing and attempted bank transfer triggered an automatic temporary suspension of any proxy authority Richard previously held.”

“So what does that mean?”

“It means your father may have walked into this house believing he controlled your inheritance.”

A second contraction tightened through me.

Margaret waited until it passed.

Then she finished.

“What he actually did was surrender whatever control Daniel had allowed him to keep.”

An officer approached the ambulance.

“Mrs. Mercer?”

“Yes?”

“Your father says he owns the property.”

“He doesn’t.”

“We’re confirming that.”

My phone buzzed.

Margaret had sent me a document.

At the top were the words:

TEMPORARY NOTICE OF TRUST PROTECTION.

Below that was Daniel’s signature.

I stared at it.

For three weeks, I had been desperate to see his handwriting again.

I had never imagined it would return like this.

A final line had been typed beneath his signature.

In the event of my death, protect Emily first.

Everything else comes second.

I covered my mouth.

For the first time since Daniel’s funeral, I cried.
